1. Data Controller
The Data Controller is Gazzera S.r.l., registered office at Via dell’Aviazione snc, 12040 Cervere (CN), Italy. Tax code and VAT number 02140810041, entered in the Cuneo Companies Register, R.E.A. no. 157287, share capital €46,800.00 fully paid up.
Contact details for any matter concerning personal data: phone +39 0172 495790, email info@gazzeraitaly.com. The Controller has not appointed a Data Protection Officer (DPO), as the legal conditions requiring one do not apply.
2. Scope of the processing
The Controller processes ordinary identifying data, not belonging to the special categories referred to in Arts. 9 and 10 GDPR: in particular first and last name, company name, tax code, VAT number, email address, telephone number and the content you send us (application description, diagrams and technical specifications attached).
Technical data automatically collected by the website during browsing are also processed, as described in section 4.
3. Purposes of the processing and legal basis
Your personal data are processed, without the need for express consent pursuant to Art. 6(1)(b), (c) and (f) GDPR, for the following purposes:
- to respond to requests for information, quotations and technical support sent to us through the website, by telephone or by email, and to carry out the resulting pre-contractual measures;
- to fulfil pre-contractual, contractual and tax obligations arising from existing relationships;
- to comply with obligations laid down by law, regulation, EU legislation or an order of the Authorities;
- to exercise the Controller’s rights, for example the right of defence in legal proceedings;
- to ensure the security and correct operation of the website, on the basis of the Controller’s legitimate interest.
For any marketing purpose, such as sending commercial communications or the newsletter, you will be asked for specific consent, freely given and revocable at any time. Statistical measurement of browsing takes place only with prior consent, as described in the cookie policy.
4. Data collected through this website
Contact form. The fields marked as required (full name, company, email, application description) are necessary in order to reply to you; the other fields and any attachments are optional and are used only to assess the technical request. The request reaches our mailbox and is recorded in our contact management tools.
Virtual assistant. The website offers an assistant that answers questions about our products. The text you type into the chat is sent to an artificial intelligence service provider, which processes it only for as long as needed to generate the answer. Please do not enter personal, confidential or unnecessary data into the chat: for project-related requests, please use the contact form.
Technical browsing data. The systems serving the website automatically record certain technical information (IP address, browser and device type, page requested, date and time), needed to deliver the pages, ensure security and diagnose malfunctions. These data are not used to identify you.
Cookies and measurement. The use of cookies and measurement tools, together with how to give or withdraw consent, is described in the cookie policy.
5. Processing methods and retention periods
The processing is carried out by means of the operations referred to in Art. 4(2) GDPR: collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure, alignment or combination, restriction, erasure or destruction. Data are processed both on paper and by electronic and automated means, with technical and organisational measures adequate to protect them from unauthorised access, loss or disclosure.
Data relating to business relationships are kept for as long as necessary for the stated purposes and in any case for no longer than 10 years from the end of the relationship, as provided for by Art. 2220 of the Italian Civil Code. Requests sent through the website that do not lead to a business relationship are kept for as long as needed to reply and to handle any follow-up, and in any case for no longer than 24 months.
6. Access to the data
Your data may be made accessible, for the purposes set out in section 3, to the Controller’s employees and collaborators, in their capacity as persons authorised to process data, internal processors or system administrators, duly appointed and instructed; and to third parties performing outsourced activities on behalf of the Controller (IT and website maintenance providers, consultants, professional firms, banks), appointed as data processors pursuant to Art. 28 GDPR.
7. Disclosure of the data
Without the need for express consent, pursuant to Art. 6(1)(b) and (c) GDPR, the Controller may disclose your data for the purposes set out in section 3 to supervisory bodies, judicial authorities and any other party to whom disclosure is mandatory by law. Your data will never be disseminated.
8. Website providers and data transfers
To operate the website and the services it hosts we rely on specialised providers, appointed as data processors, acting on our instructions:
- website hosting and content delivery network;
- artificial intelligence service generating the virtual assistant’s answers;
- cookie consent management platform;
- email and business contact management platforms;
- browsing measurement tools, active only with prior consent.
Some of these providers are based, or run infrastructure, outside the European Union. In such cases the transfer takes place on the basis of European Commission adequacy decisions or of the Standard Contractual Clauses and the further safeguards provided for in Chapter V GDPR. Beyond these cases, your data are not transferred outside the European Union, except where the transfer is necessary to perform obligations arising from the contract or the order, for example forwarding an order to a foreign supplier.
9. Nature of the provision of data and consequences of refusal
Providing the data for the purposes set out in section 3 is mandatory: without them we will be unable to respond to your request or provide the services described. Providing data for marketing purposes is optional, and refusal has no consequences for existing relationships.
10. Rights of the data subject
As a data subject you are granted the rights under Art. 15 GDPR and, where applicable, those under Arts. 16-22: right to rectification, right to erasure, right to restriction of processing, right to data portability and right to object. You also have the right to withdraw your consent at any time, without affecting the lawfulness of processing carried out before withdrawal, and the right to lodge a complaint with the Italian Data Protection Authority.
11. How to exercise your rights
You may exercise the rights set out in section 10 at any time by sending a registered letter with return receipt to the Controller’s registered office or an email to info@gazzeraitaly.com, for the attention of Mr Simone Gazzera, appointed to handle data subject requests. We will reply within the time limits laid down by the GDPR.
12. Data processors
The complete and updated list of data processors is kept at the Controller’s administrative offices and is available on request, using the means set out in section 11.
